SHARK Futures Terms of Service

Effective Date: March 26, 2026

PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SERVICES (DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.

SHARK Futures is for educational and skill-assessment purposes only. SHARK Futures is a simulated trading evaluation platform that runs evaluation programs and funded trading opportunities at the Company's discretion.

1. Introduction

Welcome to SHARK Futures. This website (https://sharkfutures.com) and all related services are owned and operated by UAB Propfirms (company registration number 307586597), a private limited liability company registered in the Republic of Lithuania, European Union, with its registered office at Antano Tumeno g. 4, LT-01110, Vilnius, Lithuania (hereinafter "SHARK Futures," "the Company," "we," "us," or "our").

These Terms of Service (the "Terms") are a binding contract between you and UAB Propfirms. You must agree to and accept all of the Terms, or you don't have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document, as well as those in our Privacy Policy, Risk Disclosure, and Cookie Policy.

We reserve the right to change these Terms at any time. If we do, we will notify you by placing a notice on sharkfutures.com, by sending you an email, and/or by other reasonable means. If you don't agree with the new Terms, you are free to reject them unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

2. Eligibility

a. You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater) to use our Services.

c. You represent that you are not subject to sanctions administered by the European Union, United Nations, United States (OFAC), or any other applicable authority.

d. Void where prohibited. Not all features, products, or services are available in all geographic locations. SHARK Futures reserves the right to limit the availability of any feature, product, or service to any person or geographic area at its sole discretion.

3. Description of Services

SHARK Futures offers simulated trading evaluation programs ("Challenges") and funded trading opportunities for futures instruments listed on the CME, COMEX, NYMEX, and CBOT exchanges.

Our Services include:

• Basic Challenge: Simulated trading programs where participants demonstrate proficiency against predefined rules and profit targets

• Instant PRO Accounts: Direct access to funded accounts without multi-phase evaluation

• Funded (PRO/Live) Accounts: Trading accounts allocated to traders who successfully complete evaluation or purchase instant access

SHARK Futures is NOT a broker, investment adviser, futures commission merchant (FCM), or financial institution. We do not provide investment advice, manage client funds as a fiduciary, or act as an intermediary in securities or futures transactions. Our programs are educational and skill-assessment tools.

Fees paid for evaluations and challenges are service fees for access to our simulated trading platform they are not investments, deposits, or trading capital.

4. Account Registration

a. You may be required to sign up for an account and select a password. You promise to provide accurate, complete, and current registration information.

b. We only allow ONE account per trader (one email address per person). If you open a new account, you must contact us to close your old one. Multiple accounts per individual are prohibited and may result in immediate termination.

c. You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.

d. You may not transfer your account to anyone else without our prior written permission.

5. Trading Rules and Account Conditions

a. Maximum Funded Accounts: Traders may hold a maximum of 5 funded accounts simultaneously across PRO and Instant PRO programs, and 1 Live account.

b. Profit Split:

• PRO and Instant PRO accounts: 90/10 (90% to trader, 10% to SHARK Futures)

• Live accounts: 80/20 (80% to trader, 20% to SHARK Futures)

c. Payouts:

• Minimum payout: $250 USD

• Balance buffer of $100 USD must be maintained after payout

• Payouts processed through our payout partner Rise, subject to their terms and processing times

• All payouts are subject to review and compliance with SHARK Futures program terms and risk guidelines at our full discretion

d. Trading Platforms: Volumetrica (primary), Quantower, ATAS. Market data via DxFeed.

e. All trading activity is subject to our published trading rules, drawdown limits, and risk parameters. These may be updated at our discretion.

6. Prohibited Conduct

You represent, warrant, and agree that you will NOT:

a. Provide false, inaccurate, or misleading information during registration or KYC;

b. Use multiple accounts, identities, or email addresses to circumvent limits;

c. Exploit system errors, latency, data feed irregularities, or platform malfunctions ("latency arbitrage," "bug exploitation");

d. Engage in gambling behavior, martingale strategies, or strategies that exploit the simulated environment rather than demonstrating genuine trading skill;

e. Copy trades between multiple accounts to create correlated risk designed to exploit drawdown rules;

f. Use third-party automation, trade copiers, or algorithmic tools without disclosure and compliance with our automation policy. You are fully responsible for any trade copier or automation connected to your account, including configuration, monitoring, and all consequences;

g. Engage in activity that disrupts or interferes with our Services, servers, or networks;

h. Share, resell, or transfer your account access to any third party;

i. Share SHARK Futures correspondence publicly without permission;

j. Use our Services for money laundering, terrorist financing, or any illegal purpose;

k. Decompile, reverse engineer, crawl, scrape, or spider any part of our Services;

l. Attempt to obtain passwords, accounts, or security information from other users.

A violation of any of the foregoing is grounds for termination of your right to use the Services.

7. Customer Due Diligence (KYC) & Anti-Money Laundering (AML)

a. SHARK Futures implements KYC and AML procedures in compliance with Lithuanian and EU regulations, including the EU's Anti-Money Laundering Directives.

b. You may be required to provide government-issued identification, proof of address, and other documentation before payouts are processed or at any point during use of Services.

c. Enhanced Due Diligence (EDD) is conducted for high-risk customers. We implement ongoing transaction monitoring with automated systems and predefined thresholds.

d. We may report suspicious activities to the Financial Crime Investigation Service of Lithuania (FNTT) and other relevant authorities as required by law.

e. Accounts that fail to complete KYC within a reasonable timeframe may be suspended or terminated.

8. Fees, Payments, and Refund Policy

a. All fees are displayed on our website at purchase. Prices are in USD unless specified otherwise.

b. SHARK Futures uses third-party payment processors. We do not directly store your credit card information. Paysagi

c. Convenience fees: A non-refundable convenience fee of 5% is applied to all transactions processed through our payment portal. This fee covers payment processing costs and is added to the total charge for the service purchased. By proceeding to checkout, you agree to this fee.

d. Subscription accounts (if applicable) will automatically renew every 30 days unless cancelled. Renewal does NOT reset your account or change your balance. You are responsible for cancelling your subscription to avoid future charges.

e. Refund Policy: In accordance with EU consumer protection law (Directive 2011/83/EU), you have a 14-day cooling-off period from the date of purchase. If no trading activity has occurred on your account within this period, you may request a full refund. Once trading activity has occurred on your account, you expressly waive your right of withdrawal and no refund will be issued, as the digital service has been fully performed with your prior consent. Reset fees are non-refundable once processed. To request a refund, contact support@sharkfutures.com within 14 days of purchase.

9. Dispute Policy

Customers who improperly dispute charges or request chargebacks with their bank will be permanently banned from the platform and will not be awarded funded accounts. If you have a billing question, contact support@sharkfutures.com before disputing with your bank.

10. Software and Platform Failures

By using our Services, you understand that SHARK Futures does not control the trading platforms (Volumetrica, Quantower, ATAS) or data feeds (DxFeed). Uncontrollable risks in electronic trading include power outages, internet failures, hardware/software/server failures, and data feed interruptions.

You acknowledge these risks and choose to use our Services regardless. SHARK Futures is not responsible for platform errors, data inaccuracies, or execution failures caused by third-party systems.

11. Intellectual Property

a. All content on sharkfutures.com including text, graphics, logos, images, code, and designs is the intellectual property of UAB Propfirms and is protected by applicable copyright and trademark law.

b. You may not reproduce, distribute, modify, display, or transmit any content without prior written consent.

c. Any content you post through our open communication tools (Discord, support chat, forums) grants SHARK Futures a royalty-free, perpetual, sublicensable, irrevocable, worldwide license to reproduce, modify, adapt, publish, display, and distribute as we see fit. This does not apply to information provided during registration (covered by our Privacy Policy).

12. Limitation of Warranty

Our Services are provided "AS IS" and "AS AVAILABLE." We do not warrant that:

a. Our Services will meet your needs or requirements;

b. Our Services will be uninterrupted, timely, secure, or error-free;

c. Information obtained through our Services will be accurate or reliable;

d. Defects will be corrected.

UNLESS OTHERWISE EXPRESSED, UAB PROPFIRMS EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

You expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of our Services. UAB Propfirms will not be liable for any direct, indirect, incidental, consequential, or exemplary loss or damages incurred by you as a result of using our Services, including changes, data loss, cancellation, loss of access, or downtime, to the full extent that applicable limitation of liability laws apply.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable EU law, including liability for death or personal injury caused by negligence, or fraud.

14. Indemnification

You agree to indemnify and hold harmless UAB Propfirms and its directors, officers, employees, agents, and affiliates from and against all losses, expenses, damages, and costs (including reasonable legal fees) arising from your violation of these Terms, unauthorized activity on your account, or your use of the Services.

15. Account Termination

a. We may, at our sole discretion, suspend or terminate your access with or without notice for any reason, including breach of these Terms, suspected fraud, or exploitative trading behavior.

b. Upon termination, your right to use our Services ceases immediately. Pending payouts may be forfeited if termination is due to breach of Terms.

c. Any suspected illegal, fraudulent, or abusive activity may be referred to appropriate law enforcement authorities.

16. Governing Law and Jurisdiction

a. These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict of law principles.

b. Any disputes shall first be submitted to good-faith negotiation for 30 days.

c. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Vilnius, Republic of Lithuania.

d. For EU consumers: Nothing in these Terms limits your statutory rights under EU consumer protection law (Directive 2011/83/EU). You may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

17. Force Majeure

We shall not be liable for failure or delay due to circumstances beyond our reasonable control, including natural disasters, pandemics, war, government actions, exchange outages, or internet failures.

18. Miscellaneous

a. Entire Agreement: These Terms, together with our Privacy Policy, Risk Disclosure, and Cookie Policy, constitute the entire agreement.

b. Severability: If any provision is unenforceable, remaining provisions continue in full force.

c. Waiver: Failure to enforce any right shall not constitute a waiver.

d. Assignment: You may not assign your rights without our written consent. We may assign at any time.
